If my husband is on the deed of the home but the mortgage it totally in my name can I do a short sale with him?
I can not afford the home and I have moved out because of issues with us. However I want to do a short sale or deed in lieu of foreclosure but he is on the deed of the home I am being told. What else can I do right now.

0If his name is on the deed, whatever you do, he has to agree to it.
You can’t sell the house out from under him, just to get out of the mortgage, without his permission.

0Who are you being told by that you can’t sell it? Go to the nearest Title company and have them run the title search to see for sure. They will do this for free. Just tell them you are selling and you want to make sure you can sell without any problems. That’s the only way you will know for sure you can’t sell it w/o others signature..
If you can sell it by yourself or not, get your bank to agree to the short sale, and let them put the price on it.
