Legal Question? It's kind of long, but I really need to know what to do :(?

O.K, so this is kind of a long story so I'm going to shorten it as much as possible. In January of 2011, I started babysitting for a friend of my best friend. The agreement was that she would pay me $ 40 for each day I babysat. After a while she stopped paying me promising that she would pay me later because something had came up. She owed me for two weeks before she went to Panama City and the two weeks after. So at $ 40 a day for 7 days would be $ 280 and $ 280 per week for the 4 weeks she didn't pay would be $ 1,120. At the end of the month my boyfriend encouraged me to stop babysitting for her which I did, she sent me messages cussing me out and accusing me of things I never did, and saying she doesn't owe me that much. I have babysat since I was 10 and have never cheated anyone. I told her that since I did quit without a notice to be fair I would take off the last week so all she would have to give me is $ 840, but she doesn't even want to do that. I told her that I had a Maurice's bill that I needed paid off so she gave me her debit card but I can't use the card because she won't give me the pin. So not only do I have a bill in my name that is now costing more because of late fees, I couldn't even take my mom to the hospital when she needed because I didn't have the gas to make it to where she lives because I would have been stranded. This girl has messed me up in so many ways and after all I've been through she still refuses to pay me and cusses at me when I ask for a little money. I made sure to provide her and her kids with everything they needed I would take her kids to the movies, out to eat, and to the fair all with MY money. She never gave me money to take her kids places, it all came out of my pocket. There were even times I let her use my car to drive to work cause she didn't have a car and she would never put gas in it. I dropped two of my college courses so I could accommodate her work schedule, and after a while she took advantage of me and started making me come an hour to two hours before she had to go to work and would stay close to 4 hours at the place she worked after they had closed down to spend time with her boyfriend. So I was babysitting 7 days a week from 4p.m. to about 5a.m. for a whole month with no pay, I have tried to be fair about the situation but she doesn't want to be. I have thought about take her to small claims court but in the state of Alabama you have to be 19 to file a claim and I am only 18 and by the time I turn 19 it will be too late. My question is, I still have her debit card how legal would it be to go to the store and run her card as credit and buy something for the amount she owes me ($ 840) and return it to get cash back? I have the text message where she gave me permission to use her card to pay my Maurice's bill but seeing how I can't because I don't have the pin or any bank information to, would it be legal to do that? I'm just trying to figure out what to do because she messed everything up for me so badly and I just feel like I don't deserve what she is doing to me after all that I have done for her and for her children. I'm sorry this is so long, but I just wanted to share the important details, please tell me what I can do because I feel so trapped :(

Will I still get my refund?

I recently had problems getting my refund off my Rush Card. Thank God...I know now I will be getting a paper check in the mail within 3-6 weeks. And I already went to a credit union and opened up a savings account so I don't have to pay thoes high check-cashing fees. BUT, the only problem I have now is will I ever get my money, because I just noticed today that Rush Card didn't put my whole social security number on the reversal. Instead of putting 123-45-6789 they put 123-45-678. Will this cause a confusion? Below is how the online statement shows. As for the reversal, look how long it took to be reversed, it just wasn't reversed day 1. I believe Rush Card did this on purpose to have me waiting a long period of time for my money. I had nasty phone conversations with them and made a complaint with the BBB. It fot so bad, every time I called, hey picked up the phone and hung up in my face, constantly.

What 'type' of lawyer would I need to contact if I'm having trouble with a retail employer?

I know there are lawyers for different types of cases and work environments. I'm being accused by my current job of something I didn't do (they're saying I used a coworker's sales number 'in between mine' on one single night a couple of weeks ago). I've been with the company for nearly 2 years. I have quite a few documented emails regarding our constant connection problems with the registers, which go up an down frequently on a daily basis. When that happens, we've had all sorts of crazy and off the wall stuff happen that I didn't think a register could do - but all of us at the store have experienced it. I'm being blamed for something that I feel is a computer error. The Loss Prevention Director of the company has made a few 'threats' but so far all that he has is a video of me in front of the register at the alleged time and a "list of transactions" from the time. My sales number, however, appears on a ton of sales that night. The coworker's number in question only showed up what looks to be around 2-3 hours, and they weren't even there during that time. My number continued on ringing sales. I'm looking for another job, because the whole is a disaster and one of the managers has been making up complete lies about me trying to "get me into trouble" with the loss prevent by saying off the wall stuff like his most recent lie: he told the store manager that I said to him that the "company would pay for me lawyer fees." I don't have a lawyer as of yet; I informed the loss prevention director of that when I was questioned about it, and he said that these two workers have "given statements" about me. However, the two workers are actually one - the asst. manager told the store manager a lie of gossip and she believed him, so the loss prevention guy somehow considers her a "second statement." Again, with no proof of either. This asst. manager has said derogatory things about me to many employees past and present, and one time was very racist against me. He told another employee (who no longer works there, of course) and that employee told me. I informed my store manager of it and nobody did anything about his comments. He doesn't like me because he apparently is scared that I might take his job. What kind of lawyer can I get for this, if any? What's my best option? I basically want to leave this company as soon as I find another job. I do not want any 'trail' following me to cause any trouble once I am working another job. This company is in violation of OSHA standards for bathroom breaks for employees working up to 8+ hours alone with no help or coverage, yet they cannot close the store at all due to policy. The computer equipment at our stores is SO bad that employees are frustrated to come to work daily because we have to do a lot of "manual transactions" because credit cards won't swipe due to the system connection issues. When the connection goes down and comes back up, drawers mysteriously come up over/short of cash due to transactions that didn't process properly. I'm concerned that this system is kicking out a lot of errors; do I have a defense against these allegations? If so, what? Note that I am not trying to "sue them" for anything. I'm trying to cut the nonsense, get another job and have them drop all of this stuff that doesn't make a lot of sense. This company LP guy has been trying and trying and trying to "press" me into admitting that I am "guilty" to something that I am not aware of doing. He has hurled all kinds of threats such as, "Do you know what can happen to you if you say you aren't guilty and you are found guilty?" and has asked me dumb questions similar to, "Do you know any other employees sales numbers? I know that some places post numbers by the registers." What in the...? Why would a job POST private employee numbers next to registers? I am not based in the UK - this was posted on US Yahoo Answers...

Please help about my job. i dont know why i keep stressing over it.?

Hi, i work at baskin robbins for over 3 weeks.i hate it there. i did since the 1st day. and i know work isnt the best place to be, i know when you work you have to work with people who are mean and i know work cant always be fun. but i dislike it very much. the boss always yells at everyone, including me and says that i am stupid for making a mistake. but i didnt make any mistake. i just asked her a question about the credit card machine. i dont understand why she has to be so angry all of the time. she is 3 months pregnant but that does not mean she can call people stupid and yell for no reason all of the time. and i hate it there. i really want to quit and a lot of people tell me that i should. but i also dont want to because then what other job am i going to get over the summer? some places are hiring. but its so hard to find a good job. and i should look for new places be4 i quit.but i just want to leave. i do ignore her, and its not only her. its the place, its extremely hard to scoop ice cream and work in the back. i think i will be better at stocking shelf's in another store or folding clothes ( even though i dont even fold my clothes at home lol ) or at the cash register. i need to tell the other boss if i still want to work there because he asked me. and i dont know what to say nor do. its so hard to make up my mind, what would you do? what should i do? i know since i dont have a family to take care of i can quit at anytime i want, but i feel bad for not having a job for right now to pay for my own little things. tehe. but the job is really stressing me out and i dont know why i keep thinking of it. i asked a lot of people what to do ( even people i am not friends with? lol.) and 50% of them said quit and the other said dont. so im still sooo lost of what to do. i know its my choice what to do, but i need some help. any advice??? please help!!!!! iloveyou

Could you please give me some advise on handling a certain part of my cashier job?

Hello. I have been doing cashier jobs to help pay for my college-related expenses and have been doing cashier jobs both in the beverage & food industry as well as the retail industry. I try my best to provide the best customer customer service, regardless of how they treat me. I recently started working at this grocery store a few blocks away from my school. And I see my fare share of interesting people. One time I even say a gay couple come up. and they were holding each other just like any other heterosexual couple. I did not say anything as I was working and I don't care who comes down my cashier isle as long as they pay. However, one day, this one person, who i originally thought was a lady, came down with her cart and groceries. I thought this person was a lady until he spoke and asked to pay one portion of his groceries with cash and the rest with debit card. When he gave me his debit card I asked to see some identification as the name on the debit was clearly a man's name. I asked him, "Sir, are you the person whose name is on this debit card? I need to see some identification." Once I started my job at this store, the general manager told me that they have had issues with identity theft with credit/debit cards. He snatched the debit card back out of my hand and in a huff paid the rest with cash. What got me really annoyed was after he was done paying and I handed him his receipts, I said, "Thank you for shopping and hope you have a nice day, sir," as we are instructed to say when we hand back the receipts. After I said that, he took his groceries out of the cart after I placed them back in the cart and left in a huff and did not even care to place the cart back in the cart return area. What did I do to upset him?

Paying debts that are in Collection/Judgements?

I live in Virginia. College Grad, Single Mom of 1 child. Employed but not in the field that I went to Grad School for, so my job only pays $ 26K/yr. I am currently living check to check, but I am trying my best to now be responsible and restore my credit. I rent a house now, and I am hoping to own my own home in 3-5 years. Current FICO is 487. I am really trying to repair the bad credit that I have accumulated but I am so overwhelmed and don't know where to start. I do not have any current Open/Revolving Accounts at all, because no one will approve me. I am living a "Cash Only" lifestyle for the past 4 years. Everything that is negative on my Credit Report is already in Collection or a Judgment against me. I have approx. $ 38,000 in College Loans and $ 12,000 in other loans(repo car, old credit cards, old utility bill). I know that I HAVE to start paying back the Student Loans ASAP otherwise my wages can be garnished. My question is; Will it make ANY difference on my Credit Report if I make payment arrangments to pay back what is already in collections or judgments against me (the OTHER $ 12,000) ? or should I just file Chapter 7 Bankruptcy on the $ 12,000 and just focus on paying back the Student Loans only? I have done some research and I know that student loans can not be discharged in a Bankruptcy unless there is undue hardship that causes me to not be able to work. Thanks in advance I just wanted to add that I graduated from Grad School in 2004. I am past the point where Uncle Sam is willing to give me any more hardship deferments. When I recenly ran my credit report and called to find out about 1 particular Judgment against me, it was the car Repo which is approx. $ 6,000. That judgment against me is being handled by a Law Firm. The person I spoke to there made it seem like I HAVE to start paying that amount down ASAP. She said I had to pay $ 600 by Sept 29th and then $ 230/month for the next 2 years. SO I know what you mean about don't wake the sleeping animals. I know that I owe that $ , but I won't have anything to spare to pay my Student Loans. That's why I am really considering Bankruptcy for everything except the Student Loans.

Should I keep paying the minimums or switch to a different method?

OK-I just went through a divorce and I ended up with all the debt (it was in my name) so now I have approximately $ 11k worth of debt. What is the best way to go about paying it off? Since the divorce I've been paying a little more than the minimum every month on all the cards (there are 5 credit cards-balances of 5500, 3300, 1300, 860, and 700). It just doesn't seem to be going anywhere though. Would it be better to pay only the minimum on 4 and then put all that extra towards the 5th one? Or any other suggestions? I work 2 jobs already and I've moved back in with my mom to help with my cash flow. I'm not spending anymore on the credit cards- I just want to get this debt knocked out asap. Any suggestions/strategies would be appreciated!

Canceled Check Summer Job-College Student?

So I worked at a motel in Wisconsin this summer. My employer canceled my check and never contacted me. As soon as I realized this I called him no answer (I did this over the course of 4 days multiple times and sometimes my calls were rejected). The check as dated 8/13/11, but i left on the 10th and that's the day he wrote the check for me (immature and inexperienced me didn't look at the date). To me it seems he planned this out pretty well. So now I'm back in Illinois, and I told my cousin what happened and he went over there (the mans address was on the check). He claims for the 5 weeks I worked there I didn't do my job. Once my (very Italian looking) cousin chatted with me he answered my call on the second ring. He claims that I left the place a mess, left 40 pill bottles out, cigarettes in the sink, bags of garbage on the side of the house, food in the fridge and freezer, dog pooh in my room, charged credit cards of people who never stayed at the motel, that my dog ruined the carpet, I wore short shorts, rooms were left uncleaned, he found an ant (yes, AN ant) and sheets were not folded in the correct manner. So on 8/11/11 he canceled my check. Now of course there are two sides to every story... I left the place in better shape than when I arrived. I whipped down walls, vacuumed, bleached the bathroom and tub, organized paperwork mopped-the whole nine yards. I did leave one of my pill bottles there (in the cupboard it was empty, my mom had to send me up a new bottle because I ran out). There were absolutely no cigarettes anywhere in the place I was staying (I don't smoke; never have. The sinks were spotless). I did leave garbage bags (Wisconsin doesn't do garbage pick up where I was and once a week my boss would collect the bags put them in the back of his truck and haul them off to the dumpster). The garbage bags were sealed and I believe they were in the garage. I did leave food at the house. I thought I was being nice because I couldn't take 2 tubs of ice cream with me on the 6 hour drive so instead of throwing them out I left them in the freezer. There was other food as well including: Ramon noodles, peanut butter, peanuts, some fruits and veggies, salad dressing, cheese, tortillas, etc. EVERYTHING was either sealed or unopened and nothing was rotten/spoiled/old/nasty. There was absolutely no dog pooh in my room and my dog didn't ruin the carpet. Most days I wore pants, but since my boss said the air conditioner looked tacky I had to uninstall the unit. So on those 100 degree days I did wear Soffee brand shorts. If he found AN ant I wouldn't be terribly surprised I mean it is summer. The rooms were cleaned (the only thing I can think of is that when I left people were still staying there and he didn't pay me for cleaning those rooms anyways. The sheets were folded the same way I was folding them for the 5 weeks I was there, and he never said it was wrong. I worked 24/7 in a motel by myself (a 20 year old, skinny tall kinda pretty..girl). I cleaned rooms, answered phones, did billing, kept paper work, and so much more and I did the best I possibly could. My boss came by 1-3 times a week for about 15 min to collect the cash and see if I was still alive. Now all that aside I need my money-I don't work all summer for free. There were nights when people would need a room at 3 in the morning or they would lock themselves out or they'd be drunk and vomiting and locked out (only once did someone vomit on me while i was opening their room and then he asked "is that all i get" mind you this was some guy old enough to be my dad! I got back in my house so fast while still being nice).

Where do we turn to for help?

My husband and I work are butts off. We have 2 young children ( 5 and 7 ) We can not make ends meet! We're 2 months begind in rent, we can't afford to buy my children the clothes that they need, our fridge and cupboards are bare..We both work so we don't qualify for ANY state aid! How can this be?? We recently lost our savings because my brother commited suicide and we had to help with his funeral. We tried to help my sister in law out as much as possible financialy so that she wouldn't lose anymore than she already has. We have no credit cards. ( We had the notion that if we didn't have the cash to buy it, we don't need it. Our car was taken because we couldn't keep up with the payments. The car we have needs $ 5000 worth of work before we can inspect it..Where do we turn for help??? If our state will help people who sit on their butts all day and collect welfare, who live better than any of us because of their state aid, why won't they help us??? I explained that we will soon be evicted if we can't pay rent and we got " Well, state law says they can't evict during winter months..Sorry, that's the best we can do to help." We have no family to help and I don't want to borrow money from friends. Because I don't know when we can pay it back. Any advice?? Anywhere else we can turn??
